Turkish Cypriot man sacked foreigner worker and filled a false document to the government to avoid paying insurance
A Turkish national who sacked his employee and prepared false documents to indicate his dismissal in order to avoid paying insurance and provident fund has been detained for fraud.
The suspect, AD, A Turkish Cypriot who is the director of the company Şad Construction LTD operating in Gönyeli was arrested and charged to court for "forgery of official documents", "putting forged documents into use" and "acting against the Residents Registration Law" following a complaint by the worker.
The issue occurred between the period, August 11-14, 2023 when his company, when prepared false documents showing a worker working for him as 'dismissed' in order to avoid paying insurance and provident fund.
Police told the court that although the suspect worked with Muhammed Usaıd at the construction site of the construction company, the suspect filled out and signed a document to the TRNC Ministry of Labor and Social Security, stating that he left the job on 30 June 2023 with the intention of defrauding the person in question in order not to pay the insurance and provident fund for the foreigners.
He explained that he forged the official document and put it into use by giving this forged official document to the Labor Department on August 14, 2023 and having it sealed.
Police stated that Muhammed Usaıd filed a complaint with the police on August 18, 2023, but legal action was initiated against Muhammed Usaıd because he did not have permit to reside in the TRNC.
The police noted that upon the allegation that Usaid's passport was seized by the suspect while his file was being discussed in court, an order was also given to initiate an investigation against the suspect under Article 85 of Chapter.
In light of all these facts, he told the court that the suspect made a voluntary statement when he was summoned to the Judicial Branch on January 18, 2024 and the charges against him were reported.
Police said that the suspect was fined 36,000 TL for employing workers without permit but he did not pay the fine. Police requested that he be released on bail.
The court judge ordered that the suspect be tried without arrest, on the condition that he deposits a cash guarantee of 20,000 TL and two guarantors sign a surety bond worth 300,000 TL each.
