TRNC court throws out case calling for the demolition of the new Gonyeli-Gulzelylurt underpass, work to resume at once

A Lefkosia court, North Cyprus has rejected the demand by property owners requesting the Gonyeli municipality to demolish and removed the new under-pass along the Gonyeli-Guzelyurt high way.

The new underground bypass project across the Lefkosa - Güzelyurt highway in Gonyeli was abandoned in May, 2018 due to a court injunction after residents and business owners filed for it's cancellation.

Work on the underpass project which has reached advanced stage stalled for almost a year when two business owner in the area dragged the municipality to court for what they described as a Berlin wall blocking and affecting their business and devaluing their properties. 

The two plaintiffs took the municipality to court on charges that the underpass construction damaged six houses, reduced their property value to zero and way of exit blocked. They demanded that the municipality demolished the project and replace it with a smooth highway.

The court ordered the municipality to pay the two plaintiffs a compensation of 10,000 Pounds for case cost.

On the other hand, one of the plaintiffs requested the municipality to pay the sum of 5,000 Turkish Lira for trespassing into his private land, 15,000 TL for property damages and 50,000TL for general damage and case cost.

The Mayor of the municipality, Ahmet Benli who welcomed the court decision, noted that work will commence at once on the underpass project and thanked the public for their patience, trust and understanding.

The subway project that connects Gönyeli and Yenikent. People traveling to Guzelyurt and back to Lefkosa faced difficulties trying to by-pass the bridge and were faced with lots of traffic on the roads.

Citizens at different time staged protest at the site calling for a speedy completion of the project.
