Knowing your right as a student in North Cyprus
Not being aware of the legal rights of university students coming to the country to study causes them to be victimized by some employers.
University students coming to study in the country are being victimized by some employers because they do not know the legal regulations.
These students do not undertake insurance investments as required by the law, and their working hours are not regulated by the employer as required by the law.
However, the Foreigners' Work Permits Regulation also regulates student work permits in the country.
According to this charter, a worker may be employed for a maximum of 4 hours a day and a maximum of 24 hours per week, and the wage must be paid at the minimum wage rate per hour.
Also according to the statute; students are prohibited from working in night clubs, bet offices and casinos.
In addition, the circular issued in March of this year also prohibited university students from working in the construction sector.
Number of workers in student status
According to the Law on Work Permits of Foreigners; Foreign students who are studying in the Turkish Republic of Northern Cyprus (TRNC) may have a minimum of 6 months and a maximum of 1 year work permit.
The number of foreign workers who can be employed in a workplace or job cannot be more than 50 percent of the total number of workers employed full time.
Student Work Permit, a must
Employers wishing to employ foreign students are required to obtain a Student Work Permit for them.
Foreign students who would like to employ a foreigner in their workplaces or workplaces with the Work Permit for Workers who intend to employ a foreigner must be 18 years of age.
In addition, they must have a valid Student Permit obtained from the relevant authorities in the Turkish Republic of Northern Cyprus and this period must be at least 90 days.
Documents must be completed
For the work permit application, the employer registered in the Turkish Republic of Northern Cyprus must fill in the application form prepared by the Ministry as required and submit it to the Ministry or the unit it creates.
The employers who will apply for a Student Work Permit under this article must fill in the application form, which is in the annex to the regulation issued in the date of this regulation, as stated in the explanation section of the form and add all the documents mentioned in the form to the application form.
If the form used for this purpose is incomplete and / or the required documents are missing, the application is not subject to any processing until the missing issues are completed.
Additional documents may be requested
The Ministry may request additional documents for both the employer and foreign nationals in order to be able to evaluate the application in a more sound and accurate manner.
Applicant employers are responsible for completing the form completely and submitting the requested documents as required.
No more than 4 hours a day
Foreign students employed with a Student Work Permit cannot be employed for a total of 4 (four) hours per day, for a total of 24 (twenty-four) hours per week.
Foreign students working with a Student Work Permit are prohibited from working more than 24 hours a day, and / or overtime.
Cannot run in casino, nightclub, betting houses and constructions
Employers take the necessary measures to ensure that the working hours of the foreign nationals working with the Student Work Permit will not interfere with their education.
Foreigners may not be employed in the workplaces that offer services related to the Night Club and Casino and Bet Office, and the applications to be made by them will not be processed and rejected.
In addition, in March of the current year, the Ministry of National Education issued a circular to prohibit students from working in the construction sector.
Employment under the law.
In the case of a workplace or employer operating in the Turkish Republic of Northern Cyprus, the Work Permit for Student Work Permits to be made for the same person in the same workplace after the employment of the Workers with Work Permits in any way is subject to the conditions stipulated in the Student Work Permit applications for the first time.
Foreigners who are working with a Student Work Permit are employed by their employers under the social security laws and labor laws of the Turkish Republic of Northern Cyprus.
If a foreign worker who has a Student Work Permit does not start the work he / she has been granted permission to, or has a defect in progress after the start, termination of the service contract by the employer or the termination of the business relationship or any relationship with the university, his / her permit shall be deemed invalid and canceled.
The rights of foreign workers arising from the Labor Law and other laws are reserved due to the termination of the employment relationship.
A student who has graduated from the University can get a work permit by being exempted from the pre-authorization rules in case of application within 30 days provided that a worker with a work permit is in the same workplace.
